Although he adds the opinions of Bernstein and Flesch to his own, the fact is that except in legal contexts aver hardly ever means anything else. Copperud's objection appears to be based on dictionary definitions—for instance "to declare positively." But one must remember that the degree of positiveness is often more apparent to the writer than it is to the reader.
