      There is some debate over whether or not this term should be spelled with h. You may want to use the Carta spelling because (1) it agrees with the pronunciation \\\\,mag-nǝ-'kärt-ǝ\\\\ that is used for either spelling, (2) it agrees with the vote by the House of Lords discussed by Gowers in Fowler 1965 (and therefore may be construed as the officially sanctioned spelling), and (3) it agrees with the larger portion of the citational evidence for this term in the Merriam-Webster files.

      On the other hand, if you already use and prefer the Charta spelling, you can defend your usage on the grounds that it has been around for over three and a half centuries and has been used by numerous reputable writers on both sides of the Atlantic. (By the way, the claim of Partridge 1942, echoed by Copperud, that Charta isn't Latin, is not true.)

      One further point is worth mentioning: when the original document and not a latter-day counterpart is being referred to, Magna C(h)arta is usually not preceded by the (see the Trevelyan, Barlow, and Dickens citations above). Although literal American use with the definite article is occasionally found in print (see the Littlefield citation above), in British usage the article is omitted. We suspect, however, that many Americans who are familiar with the term only from their school days use the definite article.
